Construction Contracts
Construction contracts are always unique to each
project. Standard forms are often amended
varying the conditions to reallocate the risk and it
is rare that the standard clauses are left entirely
as the original drafter intended.
It is therefore a misnomer to utilise the text book
apportionment of responsibilities and only a specific review
of the agreed conditions can determine the risk allocation.
Notwithstanding that, there are still common
themes throughout standard forms and procurement
routes.
Common standard form contracts are JCT and NEC in the UK
and various FIDIC based forms on the continent and the
middle east. In the USA the AIA forms are common.
